On July 28, 2026, Disney filed a motion to dismiss a lawsuit filed by the Peter Law Group on behalf Q’orianka Kilcher accusing the filmmaker of misusing Kilcher’s likeness to create the protagonist Neytiri from their hit “Avatar” movies. Following is a statement from Arnold Peter concerning the motion:
“This case presents issues at the cutting edge of the intersection between technology and the law, and we anticipated that Defendants would vigorously challenge the pleadings at the outset. We remain confident that our claims are well grounded both in long-established legal principles, as well as recent statutory developments and evolving case law addressing intellectual property, rights of publicity, and emerging technologies. We believe the complaint adequately states viable claims, and we are confident it will withstand the anticipated motions. While we respect the Defendants’ advocacy, we expect the Court will permit the case to proceed into discovery and ultimately to a jury trial, where the factual issues underlying our clients’ claims can be fully and fairly adjudicated.”
